Sex-change regret: doctors, clinics sued for ‘misdiagnosis’

Two recent lawsuits filed against local medical clinics allege that medical professionals are in a rush to confuse young patients about their sexual identity when undergoing gender reassignment treatment or surgery. I threw away the traditional guardrails of practice.

According to the complaint, the plaintiff visited Fenway in 2013 and a man asked her about hormone therapy to help her live “full-time as a woman.”

The plaintiff claims that at the time he suffered from “internalized homophobia,” which prevented him from accepting homosexuality. Meanwhile, Fenway staff advised Kahlan to undergo hormone therapy, but he often overlooked the diagnosis, the lawsuit alleges.

Karlan’s lawsuit does not state any medical malpractice claims, but rather is filed under Section 1557 of the Affordable Care Act. Karlan’s attorney, Mitra N. Forhar of San Francisco, argued that Section 1557 creates an implied private right of action by incorporating by reference other civil rights law enforcement mechanisms that authorize private causes of action. Her client’s case is based on the theory that

The plaintiffs allege that Fenway medical professionals “deliberately waived” established, evidence-based, and generally accepted clinical guidelines when providing medical care to transgender people.

“In deciding to abandon evidence-based care, defendants relied solely on people in pain without medical knowledge and those who were happy with the transition, ignoring the experiences of those who regretted it. , thus attracting patients who “deliberately disregarded the safety risks to the same sex,” the plaintiffs’ complaint states. “Exclusive consideration of only positive results in medical research is known as ‘survivor bias,’ and the resulting conclusions are unreliable and erroneous.”

Physicians at Hasbro Children’s Hospital Lifestyle Medicine Group in Providence are facing a similar lawsuit filed Oct. 23 in Bristol Superior Court.

“The changes that testosterone has caused to her body are not a group of ideologues trying to promote their own agenda and promote social issues, but rather a group of ideologues trying to assess her mental health and provide the care she needs. “Constantly reminding her that she needed an unbiased medical professional to help her,” the complaint states. “Isabelle suffers from vaginal atrophy due to heavy use of testosterone. She takes care of excess facial and body hair. She suffers from compromised bone structure. She believes that her fertility is irreversible. She continues to have mental health issues and suffers from anxiety and depression, which is exacerbated by feelings of remorse.”

In addition to the medical malpractice claims, Ayala also alleges civil conspiracy involving Lifestyle Physicians and co-defendants, the American Academy of Pediatrics. The plaintiff places much of the blame for her injuries on gender reassignment guidelines issued by the AAP in 2018.

Defendant Dr. Lafferty is the lead author of AAP’s Gender-Affirming Care Policy Statement. Ayala said she is a victim of policies that promote “radical” approaches that are not supported by evidence.

“These individuals will enshrine their ideological beliefs as authoritative in an emerging field of pediatric medicine: the treatment of rapidly increasing numbers of transgender and gender-diverse children and adolescents. “We saw an opportunity to develop new guidelines,” the complaint states.

jordan campbellJordan Campbell, a resident of Campbell Miller Payne in Dallas, represents Ayala. Campbell said he expects a “wave” of similar lawsuits to be filed across the country.

“We’ve already filed four of these lawsuits and have more in the pipeline,” Campbell said.

Campbell said he has identified six additional lawsuits brought by other attorneys and firms, including four brought by his own firm.

According to Campbell, Ayala This is the only case in which AAP was named as a defendant.

Lifestyle Medical Group and Fenway Community Health Center declined to comment on the lawsuit against them. The American Academy of Pediatrics did not respond to a request for comment at the time of writing.
