The Union Ayush Ministry on Tuesday (October 8, 2024) said it is illegal to promote Ayurvedic, Siddha, Unani and homeopathic medicines that claim “miraculous or supernatural effects” in treating diseases. It said such advertisements could “mislead and endanger” the public. health.
In a public notice, the ministry clarified that it does not certify or approve Ayurvedic, Siddha, Unani and Homeopathy (ASU&H) companies or their medicines, nor has it granted licenses to ASU&H manufacturers or companies to manufacture them for sale. I made it.
Further, as per the existing provisions of the Drugs and Cosmetics Act, 1940 and the Rules thereunder, the manufacturing license for sale of ASU&H drugs shall be granted by the State and Union Territory Licensing Authority of the State and Union Territory concerned.
“It is illegal to advertise ASU&H medicines that claim miraculous or supernatural effects on the treatment of disease. Such advertisements are misleading and endanger public health by promoting unverified or false claims. may be exposed to,” the ministry said.
The ministry further said that the Drugs and Magical Cures (Offensive Advertisement) Act, 1954 strictly prohibits advertising of drugs and magical remedies for the treatment of certain diseases and conditions.
Any person found guilty of violating this law shall be liable to a fine prescribed under the law.

According to the notification, Ayurvedic Siddha Unani (ASU) medicines, including Schedule El medicines, are mandatory to be taken under the supervision and guidance of a registered doctor of the concerned Ayush system of medicine.
The labels on the containers of such medicines will include instructions in both Hindi and English: “Caution to take under medical supervision.”
“The general public is advised to use such medicines only after consulting with the registered doctor/physician of the concerned Ayush scheme,” the ministry said.

It further warned that self-diagnosis and self-treatment with Ayurvedic, Siddha, Unani & Homeopathic (ASU&H) medicines/pharmaceuticals should be avoided.
“The public is also encouraged to report any such objectionable advertisements, false claims, fake medicines, etc. to the concerned State Licensing Department or Ministry of Ayush for appropriate action.” is stated in the notice.
