Evaluation of Drug Pricing Policies under a Potential Reconciliation Package

Budget reconciliation is an optional special procedure outlined in the Congressional Budget Act (CBA) to facilitate consideration of narrow categories of spending and tax laws.


In anticipation of the 119th Congress and anticipated activities leveraging the federal budget reconciliation process to advance drug pricing and supply chain reform, Mr. Manatt announced a wide range of drug pricing and supply chain policy proposals from the 118th Congress. We analyzed 40 separate bills and assessed which ones fall under which category. These may be subject to enactment through the budget reconciliation process. Of the 40 bills considered, only 12 bills (consisting of nine policies) appear appropriate for coordination at this time.

1 A three-fifths majority (60 votes) can waive the mandate for provisions under the Byrd Rule and allow it to proceed. Too many clauses waiving the Byrd Rule can completely jeopardize the privileged protections of a settlement bill (sometimes referred to as “deadly” to the privilege). However, “too much” is subjective and is based on the evaluations of members of Congress.
