COLOMBUS, Ohio — A nearly $50 million settlement can pay back customers who have been overcharged for more than 200 different drugs, Ohio Attorney General Dave Yost announced Wednesday.
Consumers who purchase certain common prescription medications between May 2009 and December 2019 will be eligible for compensation.
The settlement consisting of $10 million payments from New Jersey heritage drugs and $39.1 million payments from Apotex in Toronto, was filed December 15, 2016 in the U.S. District Court for the District of Connecticut.
The companies were accused of taking part in a long-term scheme to artificially inflate and manipulate the prices of a number of common prescription drugs. Some Drugs Include clendamycin phosphate for acne treatment and hydrocortisoneballate cream for skin conditions.
“This was a conspiracy that was tricking the system. We don’t tolerate any conspiracy that inflates drug prices and harms Ohio, which relies on affordable drugs,” Yost said. “We are working to restore fair competition and hold fraudsters accountable.”
A coalition of attorney generals, including Yost, has filed three anti-trust complaints against 30 corporate defendants and 25 individual executives in almost every state and territory.
- 2016: The first complaints included Heritage Pharmaceuticals, Apotex, 16 corporate defendants, two individual executives and 15 generic drugs.
- 2019: The second complaint targets 18 people from Teva Pharmaceuticals, Apotex and the largest generic drug maker in the United States, naming 16 senior executives.
- 2020: The third complaint focuses on 80 topical generic drugs, appointing 26 corporate defendants and 10 individual defendants.
The evidence in the case came from several witnesses, a database of documents of over 20 million, and millions of phone records showing conversations between more than 600 sales and pricing executives in the generic drug industry.
The complaints are detailed on networks of industry executives whom they secretly encountered at dinners and social gatherings, as well as private calls to hide illegal agreements.
