The notice comes one day after U.S. District Judge Reed O’Connor issued an order nationwide that immediately voids the ACA’s guarantees of preventive services, such as cancer screening and medicines to prevent HIV and heart disease. It has been issued. O’Connor is a judge brought to the Supreme Court in 2018 when he ruled the entire ACA unconstitutional.
This decision affects any type of service defined or updated by the U.S. Preventive Services Task Force during the 13 years the Health Care Act has been in existence. O’Connor’s order does not address contraception or other types of prevention, including vaccines. These are required by other departments of the Department of Health and Human Services and, unlike task forces, require approval by a presidential appointee.
Legal experts and public health advocates who have followed the case, which was started by a group of conservative Christian businesses and individuals in 2020, had predicted that the administration would appeal O’Connor’s ruling. It is also expected to seek a stay to block a judge’s injunction.
