HYDERABAD: The Telangana High Court recently put an end to a 25-year-long tax tussle, ruling that five Ayurvedic products manufactured and sold by Himami Ltd and Emami Ltd – Navratna Oil, Gold Turmeric Cream, Boroplus Antiseptic Cream, Boroplus Heat Rash Powder and Sona Chandi Chyawanprash – fall under the category of medicines and not cosmetics. This ruling by the high court will help these two sister companies to shed some of the additional tax burden as, while they are classified as cosmetics and attract 20% GST, if recognised as medicines with healing properties, the same rate will be 10%. It all began in the assessment year 1996-97 when the state’s commercial tax department treated them as cosmetics and started levying 20% ​​sales tax. A division bench of Justices P Sam Koshi and N Tukaramji, after hearing both the parties at length and examining the subject thoroughly, held that the five products fall under the category of medicines. The dispute was over six products manufactured and sold by two sister companies, including Nirog Dant Powder Lal. The tax authorities classified them as cosmetics and started imposing a 20% tax on them. The Sales Tax Appellate Tribunal (STAT) ruling that Dant Powder was a cosmetic product was accepted by the companies and they did not challenge the ruling.
